PRIVACY POLICY

This privacy policy has been drawn up in accordance with the requirements of Federal Law No. 152-FZ of 27.07.2006 "On Personal Data" (hereinafter — the Personal Data Law) and sets out the procedure for processing personal data and the measures for ensuring the security of personal data taken by imiji (hereinafter — the Operator).

1. General provisions

1.1. The Operator regards respect for the rights and freedoms of the individual when processing their personal data, including the protection of the right to privacy and personal and family confidentiality, as the most important purpose and condition for carrying out its activities.

1.2. This privacy policy of the Operator (hereinafter — the Policy) applies to all information that the Operator may obtain about users and visitors of the website https://imiji.io (including all subdomains and additional network addresses: https://imiji.ru, https://img.life and their subdomains).

2. Basic concepts used in the Policy

2.1. Automated processing of personal data — the processing of personal data using computer technology.

2.2. Blocking of personal data — the temporary suspension of the processing of personal data (except where processing is necessary to clarify personal data).

2.3. Website — the combination of graphic and informational materials, as well as computer programs and databases, that make them accessible on the Internet at the network address https://imiji.io (including all subdomains and additional network addresses: https://img.life, https://imiji.ru and their subdomains).

2.4. Personal data information system — a combination of personal data contained in databases and the information technologies and technical means that ensure their processing.

2.5. Processing of personal data — any action (operation) or set of actions (operations) performed on personal data, with or without the use of automation tools, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (distribution, provision, access), blocking, erasure, and destruction of personal data.

2.6. Operator — a government body, municipal body, legal entity or individual that organizes and/or carries out the processing of personal data, either independently or jointly with other persons, and that determines the purposes of processing personal data, the composition of personal data to be processed, and the actions (operations) performed with personal data.

2.7. Personal data — any information relating directly or indirectly to a specific or identifiable User of the Website.

2.8. Personal data permitted by the data subject for distribution — personal data to which an unlimited circle of persons has been granted access by the data subject, by giving consent to the processing of personal data permitted by the data subject for distribution in the manner provided by the Personal Data Law.

2.9. User — any visitor to the Website, including registered users.

2.10. Provision of personal data — actions aimed at disclosing personal data to a specific person or a specific circle of persons.

2.11. Distribution of personal data — any actions aimed at disclosing personal data to an indefinite circle of persons (transfer of personal data) or at making personal data available to an unlimited circle of persons, including the publication of personal data in the media, posting it in information and telecommunications networks, or providing access to personal data in any other manner.

2.12. Cross-border transfer of personal data — the transfer of personal data to the territory of a foreign state, to an authority of a foreign state, to a foreign individual or to a foreign legal entity.

2.13. Destruction of personal data — any actions as a result of which personal data is irretrievably destroyed, with it becoming impossible to further restore the content of the personal data in the personal data information system and/or the physical media containing the personal data are destroyed.

3. Basic rights and obligations of the Operator

3.1. The Operator has the right to:

  • receive from the data subject accurate information and/or documents containing personal data;
  • in the event that the data subject withdraws consent to the processing of personal data, or submits a request to cease processing personal data, continue processing personal data without the subject's consent where grounds specified in the Personal Data Law exist;
  • independently determine the composition and list of measures necessary and sufficient to ensure compliance with the obligations provided for by the Personal Data Law and the regulatory legal acts adopted pursuant to it, unless otherwise provided by the Personal Data Law or other federal laws.

3.2. The Operator is obligated to:

  • provide the data subject, at their request, with information concerning the processing of their personal data;
  • organize the processing of personal data in the manner established by the current legislation of the Russian Federation;
  • respond to inquiries and requests from data subjects and their legal representatives in accordance with the requirements of the Personal Data Law;
  • provide the authorized body for the protection of the rights of data subjects, at that body's request, with the necessary information within 10 days from the date such request is received;
  • publish or otherwise ensure unrestricted access to this Privacy Policy;
  • take legal, organizational and technical measures to protect personal data from unauthorized or accidental access, destruction, modification, blocking, copying, provision, distribution of personal data, as well as from other unlawful actions with respect to personal data;
  • stop the transfer (distribution, provision, access) of personal data, stop processing, and destroy personal data in the manner and cases provided by the Personal Data Law;
  • in the event that an unlawful or accidental transfer (provision, distribution, access) of personal data resulting in a violation of Users' rights is established, notify the authorized body of the incident within 24 hours from the moment such incident is discovered, and take other measures related to the identified incident within the time limits established by law;
  • fulfill other obligations provided for by the Personal Data Law.

4. Basic rights and obligations of data subjects

4.1. Data subjects have the right to:

  • receive information concerning the processing of their personal data, except as provided by federal laws;
  • require the operator to clarify their personal data, block it, or destroy it if the personal data is incomplete, outdated, inaccurate, unlawfully obtained, or is not necessary for the stated purpose of processing;
  • set a condition of prior consent when processing personal data for the purpose of promoting goods, works and services on the market;
  • withdraw consent to the processing of personal data, as well as submit a request to cease processing;
  • appeal to the authorized body for the protection of the rights of data subjects, or in court, against unlawful actions or omissions of the Operator in processing their personal data;
  • exercise other rights provided by the legislation of the Russian Federation.

4.2. Data subjects are obligated to:

  • provide the Operator with accurate information about themselves;
  • notify the Operator of any clarification (updating, modification) of their personal data.

4.3. Persons who have provided the Operator with inaccurate information about themselves, or information about another data subject without the latter's consent, are liable in accordance with the legislation of the Russian Federation.

5. Principles of processing personal data

5.1. The processing of personal data is carried out on a lawful and fair basis.

5.2. The processing of personal data is limited to achieving specific, predetermined and legitimate purposes. Processing of personal data that is incompatible with the purposes of collecting the personal data is not permitted.

5.3. It is not permitted to merge databases containing personal data that is processed for purposes incompatible with one another.

5.4. Only personal data that meets the purposes of its processing is subject to processing.

5.5. The content and scope of the personal data processed correspond to the stated purposes of processing. Excessive personal data relative to the stated purposes of its processing is not permitted.

5.6. When processing personal data, the accuracy of the personal data, its sufficiency, and, where necessary, its relevance to the purposes of processing are ensured.

5.7. Personal data is stored in a form that allows the identification of the data subject for no longer than required by the purposes of processing the personal data, unless the retention period for personal data is established by federal law, or by an agreement to which the data subject is a party, beneficiary or guarantor.

6. Purposes of processing personal data

6.1. Conclusion, performance and termination of civil-law agreements

6.1.1. Purpose of processing: the conclusion, performance and termination of civil-law agreements (the acquisition by the User (or the person on whose behalf the User acts) of the Operator's services).

6.1.2. Personal data:

  • last name, first name;
  • the name of the company on whose behalf the User acts (if any);
  • the User's field of activity (if any);
  • the User's (company's) website address (if any);
  • phone number;
  • e-mail address.

6.1.3. Legal grounds:

  • the Civil Code of the Russian Federation;
  • Federal Law No. 149-FZ of 27.07.2006 "On Information, Information Technologies and the Protection of Information";
  • the agreement concluded between the User and the Operator;
  • the consent of the data subject (where necessary).

6.2. Registration, authorization and operation of the User's account

6.2.1. Purpose of processing: registration of the User on the Website, creation and use of an account, provision of the online platform's (community's) functionality, and ensuring the security and moderation of the service.

6.2.2. Personal data:

  • phone number (for sign-in via SMS/call);
  • name, nickname (if provided by the User);
  • photo/avatar (if uploaded by the User);
  • profile data provided by the User (for example, city, description, skills, links) — if any;
  • IP address, cookies, information about actions on the site (technical logs).

6.2.3. Legal grounds:

  • the agreement (terms of use/offer);
  • the consent of the data subject (in cases provided by the Personal Data Law).

6.3. Processing of user inquiries and requests

6.3.1. Purpose of processing: processing Users' inquiries, providing technical support, and reviewing complaints and requests.

6.3.2. Personal data:

  • name (if any);
  • contact information (phone, e-mail);
  • the text of the inquiry and other information provided by the User.

6.3.3. Legal grounds:

  • the agreement (terms of use/offer);
  • the consent of the data subject (where necessary).

6.4. Collection of statistical information and improvement of service quality

6.4.1. Purpose of processing: collecting statistical information about the User's actions on the Website, and improving the quality of the Website and its content using internet statistics (analytics) services (for example, Yandex.Metrica), where such services are used.

6.4.2. Personal data:

  • cookies;
  • information about the User's actions on the Website;
  • IP address (as part of technical data).

6.4.3. Legal grounds:

  • the consent of the data subject (in cases provided by the Personal Data Law).

6.5. Notifications of news and mailings (subject to consent)

6.5.1. Purpose of processing: informing the User about service news and updates, and sending thematic publications by e-mail (subject to separate consent).

6.5.2. Personal data:

  • name (if any);
  • e-mail address.

6.5.3. Legal grounds:

  • the consent of the data subject.

7. Conditions for processing personal data

7.1. Personal data is processed with the consent of the data subject.

7.2. The processing of personal data is necessary for the performance of an agreement to which the data subject is a party, or under which the data subject is a beneficiary or guarantor, as well as for concluding an agreement at the initiative of the data subject.

7.3. The Operator may process personal data without the consent of the data subject where other grounds provided by the Personal Data Law exist.

8. Cookies and technical data

8.1. The Website may use cookies and other similar technologies (including data on the User's actions on the Website), which help ensure the operability of the service, improve the user experience, ensure security, and collect statistics.

8.2. Cookies may contain, in particular, session identifiers, device and browser information, technical parameters, IP address, date and time of access, and information about the User's actions on the Website.

8.3. The User may restrict or disable the use of cookies in their browser settings. Disabling cookies may, however, make it impossible to use certain features of the Website.

8.4. When web analytics services are used (for example, Yandex.Metrica), the processing of technical data may be carried out using cookies and other identifiers in accordance with the policies of the relevant services.

9. Procedure for the collection, storage, transfer and other types of processing of personal data

8.1. The security of the personal data processed by the Operator is ensured through the implementation of the legal, organizational and technical measures necessary to fully comply with the requirements of current legislation in the field of personal data protection.

8.2. The Operator ensures the safekeeping of personal data and takes all possible measures to prevent access to personal data by unauthorized persons.

8.3. The User's personal data may be transferred to third parties only in cases provided by the legislation of the Russian Federation, and to the extent necessary for the operation of the Website and the provision of services (for example, to a hosting provider, one-time SMS/call code delivery services, web analytics services), on the basis of agreements and subject to compliance with the requirements of personal data legislation.

8.4. The Operator may entrust the processing of personal data to third parties on the basis of agreements (instructions) concluded with them, provided that such persons maintain the confidentiality of personal data and ensure its security.

8.5. If inaccuracies in personal data are discovered, the User may update it independently (where such a feature is available on the Website) or by sending the Operator a notice to the Operator's e-mail address info@imiji.io marked "Personal data update".

8.6. The period for processing personal data is determined by the achievement of the purposes for which the personal data was collected, unless a different period is provided by an agreement or current legislation. The User may withdraw their consent to the processing of personal data at any time by sending the Operator a notice by e-mail to the Operator's e-mail address info@imiji.io marked "Withdrawal of consent to the processing of personal data".

9. List of actions performed by the Operator with the personal data received

9.1. The Operator carries out the collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (provision, access), blocking, erasure and destruction of personal data.

9.2. The Operator carries out automated processing of personal data, with the receipt and/or transfer of the information obtained via information and telecommunications networks.

10. Cross-border transfer of personal data

The Operator does not carry out cross-border transfers of personal data.

11. Confidentiality of personal data

The Operator and other persons who have gained access to personal data are obligated not to disclose it to third parties and not to distribute personal data without the consent of the data subject, unless otherwise provided by federal law.

12. Final provisions

12.1. The User may obtain any clarifications on questions of interest concerning the processing of their personal data by contacting the Operator by e-mail at info@imiji.io.

12.2. Any changes to the Operator's personal data processing policy will be reflected in this document. The Policy is valid indefinitely until replaced by a new version.
