TERMS OF USE

These Terms of Use (hereinafter — the Agreement) govern the use of the imiji online platform (including the sites imiji.io, img.life, imiji.ru and their subdomains) and set out the conditions for granting access to the Service's functionality.

1. Terms

1.1. Service — the combination of software, databases and user interface that ensure the operation of the imiji online platform at imiji.io / img.life / imiji.ru.

1.2. Operator / Administration — imiji, the operator of the Service.

1.3. User — an individual who uses the Service, including visitors and registered users.

1.4. Account — a User's account within the Service.

1.5. Content — any materials posted by the User in the Service, including (but not limited to) photos, videos, audio, texts, descriptions, links, images, covers, avatars, metadata, comments.

1.6. Work — a unit of content posted by the User in the Service (a portfolio piece, project, publication, collection, etc.).

1.7. Moderation — review of Content and/or an Account for compliance with this Agreement, the Service's rules and applicable legal requirements.

1.8. Public zone — the part of the Service accessible to an indefinite circle of persons (including visitors without registration), unless otherwise established by privacy settings.

1.9. Personal account — the section of the Service accessible to the User after authorization.

1.10. Rightsholder — a person holding exclusive rights to Content.

2. General provisions

2.1. By using the Service (including viewing pages, registering, posting Content, using its functionality), the User confirms that they have read this Agreement, understand it and accept its terms.

2.2. If the User does not agree with the terms of the Agreement, they must stop using the Service.

2.3. The Agreement constitutes a public offer within the meaning of Article 437 of the Civil Code of the Russian Federation. Registration in the Service and/or use of its functionality constitutes acceptance of the offer.

2.4. The Operator may amend the terms of the Agreement at any time. The new version takes effect from the moment it is published on the Service, unless otherwise stated in the new version.

3. Registration and access to the Service

3.1. Registration may be required for the use of certain features of the Service.

3.2. Registration is carried out by confirming a phone number using a one-time code (SMS/call) and/or by other means available in the Service.

3.3. The User undertakes to provide accurate information and keep it up to date.

3.4. The User is responsible for keeping access to their Account secure and for all actions performed using the Account.

3.5. The Operator may refuse registration or restrict access to the Service without explanation, if necessary to comply with the law, ensure the security of the Service, prevent abuse, or where there are signs of a violation of this Agreement.

4. Functionality of the Service

4.1. The Service allows the User to create a profile, publish Works, build collections, view other users' Content, interact with it, and use other features available at the time of use.

4.2. The Operator may, at its own discretion, change, supplement, restrict or discontinue any functionality of the Service (in whole or in part) without prior notice.

4.3. The Operator does not guarantee that the Service will operate continuously or error-free, or that errors will be fixed within any particular timeframe.

5. Rules for posting Content

5.1. The User may post Content in the Service only if they hold the necessary rights (including exclusive rights, licenses, permissions, consents of third parties), and subject to the legislation of the Russian Federation and this Agreement.

5.2. The User is prohibited from posting Content that:

  • violates the legislation of the Russian Federation;
  • violates the rights of third parties (including copyright and related rights, trademark rights);
  • contains personal data of third parties without a lawful basis;
  • contains defamation, threats, insults, or calls for violence or discrimination;
  • contains pornographic materials, sexual exploitation, or materials involving minors;
  • depicts cruelty or violence, or promotes prohibited substances;
  • contains malicious code, spam, phishing, or attempts at unauthorized access;
  • misleads users (for example, impersonating another person);
  • contains advertising or promotion not agreed with the Operator (where such agreement is required).

5.3. The User bears full responsibility for posted Content and the consequences of its publication.

5.4. The User understands and agrees that Content may be accessible in the public zone of the Service if the User has made it public themselves, or if the Service's functionality provides for the corresponding sections to be public.

6. Moderation, refusal to publish, and removal of Content

6.1. The Operator may moderate Content and Accounts both before and after publication.

6.2. The Operator may, at its own discretion:

  • refuse to moderate and/or publish a Work;
  • take a Work down from publication (hide it from the public zone);
  • delete a Work or other Content in whole or in part;
  • restrict access to specific features of the Service;
  • restrict the visibility of a profile or Content;
  • request additional information or proof of rights from the User.

6.3. Grounds for refusal, removal or restriction may include, without limitation:

  • Content not complying with this Agreement;
  • violation of third-party rights;
  • substantiated complaints from other users;
  • suspected fraudulent activity;
  • technical reasons (e.g., unsupported format, excessive size, upload errors);
  • non-compliance with the Service's quality requirements for publications, including the technical and/or artistic level, completeness, informativeness, presentation and relevance of the posted Work;
  • the need to comply with the legislation of the Russian Federation;
  • protection of the Service's reputation and maintenance of the quality of the catalog/showcase.

6.4. The Operator is not obligated to disclose to the User the reasons for a refusal to moderate or for removal of Content, but may do so at its discretion.

6.5. The User understands and agrees that moderation is a right of the Operator, not an obligation, and that the Operator does not guarantee the absence of materials in the Service that may infringe third-party rights.

7. Suspension, restriction and deletion of the Account

7.1. The Operator may temporarily or permanently restrict the User's access to the Service, suspend the Account or delete the Account without prior notice in cases of:

  • the User violating the terms of this Agreement;
  • violation of the legislation of the Russian Federation;
  • receipt of substantiated complaints;
  • suspected unauthorized access to or compromise of the Account;
  • use of the Service for spam, abuse, artificial inflation of metrics or other bad-faith actions;
  • the need to ensure the security of the Service;
  • discontinuation of the Service's operation;
  • a decision by the Operator aimed at maintaining the quality of the community and catalog.

7.2. The User may stop using the Service and delete the Account (if such a feature is available), or send a request to delete the Account to the Operator's e-mail address.

7.3. Upon deletion of the Account, the User's access to the functionality ceases. The Operator may retain certain information to the extent and for the period provided by the legislation of the Russian Federation (for example, for accounting purposes, handling claims, or preventing abuse).

8. Rights to Content and license

8.1. The User retains exclusive rights to their Content, unless otherwise established by an agreement with the Operator.

8.2. By posting Content in the Service, the User grants the Operator a non-exclusive, royalty-free, worldwide license to use the Content for the purposes of operating the Service, including:

  • storage, reproduction, display, publication and communication to the public;
  • technical processing (encoding, format adaptation, creating previews, compression);
  • displaying the Content in the public zone in accordance with the User's settings;
  • using excerpts of the Content to showcase the Service (showcase, collections, work samples, promotional materials).

8.3. The license is granted for the period the Content remains posted in the Service, and for a reasonable period after its removal, solely to the extent necessary for the technical completion of processes (caching, backups).

8.4. The User warrants that posting the Content does not infringe third-party rights and that they have obtained all necessary consents (including consents to use images of people, music, trademarks, etc.).

9. Intellectual property of the Service

9.1. Exclusive rights to the Service, its source code, design, structure, database, trademarks and brand elements belong to the Operator or are used on a lawful basis.

9.2. The User is granted a limited, non-exclusive, non-transferable license to use the Service within its functionality.

9.3. Any use of elements of the Service beyond the functionality provided is prohibited without the Operator's written consent.

10. Paid features (if applicable)

10.1. The Operator may introduce paid features, subscriptions or plans. Payment terms are published on the Service and/or in a separate document.

10.2. If the User acquires paid features, the parties' relationship is additionally governed by the payment terms published on the Service.

10.3. The Operator may suspend access to paid features in the event of a breach of payment terms or upon detecting abuse.

11. Liability

11.1. The User is responsible for complying with the legislation of the Russian Federation and the terms of this Agreement.

11.2. The Operator is not liable for:

  • the actions of Users and the Content they post;
  • damage arising from the use or inability to use the Service;
  • loss of data for reasons beyond the Operator's control (failures, actions of third parties, force majeure);
  • the Service not meeting the User's expectations;
  • temporary unavailability of the Service;
  • consequences of the User publishing Content in the public zone.

11.3. The Service is provided on an "as is" basis. The Operator makes no warranty that the Service will meet the User's specific purposes.

12. Notices and communications

12.1. The Operator may send the User notices related to the operation of the Service by phone, SMS, call, e-mail, and through the Service's interface.

12.2. The User agrees to receive service notices necessary for the operation of the Account and for security purposes.

13. Personal data

13.1. Personal data is processed in accordance with the Privacy Policy published on the Service.

13.2. By using the Service, the User confirms that they have read the Policy and accept its terms.

14. Dispute resolution

14.1. A pre-trial claims procedure is mandatory. The User may send a claim to the Operator at the e-mail address info@imiji.io.

14.2. The period for reviewing a claim is 10 (ten) business days.

14.3. If a dispute cannot be resolved through the claims procedure, it shall be resolved in court at the place of registration of the Operator, unless otherwise provided by the legislation of the Russian Federation.

15. Final provisions

15.1. The Agreement is valid indefinitely and applies to all users of the Service.

15.2. If any provision of the Agreement is found invalid, this does not affect the validity of the remaining provisions.
